These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Rapid Home Warranty (“Company,” “we,” “us,” or “our”) governing your access to and use of the website rapidhw.com and all associated content, features, and services (collectively, the “Site”).

By accessing or using the Site, submitting a quote request or contact form, calling our phone number, or engaging with our representatives, you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, please do not access or use the Site.

2. Description of Services

Rapid Home Warranty is a home warranty and service contract provider offering plans that cover repair or replacement of covered home systems and appliances. The Site serves as an informational and lead-generation platform through which prospective customers can request quotes and learn about available plans. Actual warranty coverage is governed solely by the separate service contract agreement executed at the time of enrollment, not by these Terms or any content on this Site.

3. Eligibility

By using this Site, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into binding agreements, and are a resident of the United States. Our home warranty plans are available to homeowners, landlords, and real estate agents for residential properties located within the United States. We reserve the right to refuse service to anyone for any lawful reason.

4. Quote Requests & Lead Submissions

By submitting any form on this Site, you:

Represent that all information you provide is accurate, complete, and current
Consent to be contacted by Rapid Home Warranty by phone (including autodialed or prerecorded calls), SMS/text message, and email using the contact information you provided, in accordance with our Privacy Policy and the TCPA disclosures included on each form
Acknowledge that submitting a form does not create any contractual obligation or guarantee of coverage, pricing, or plan availability
Acknowledge that a Rapid Home Warranty representative will contact you to discuss your options

Consent to receive marketing calls and texts is not a condition of any purchase. You may opt out at any time as described in our Privacy Policy.

5. Home Warranty Plans: Important Disclosures

All descriptions, plan summaries, coverage lists, and pricing shown on this Site are for general informational purposes only and do not constitute the complete terms of any home warranty plan. The specific terms, conditions, exclusions, limitations, and definitions of covered items are set forth in the written service contract agreement provided to you at enrollment.

By enrolling in a plan, you acknowledge and agree:

Coverage is subject to the terms of your signed service contract and applicable state regulations
Coverage typically begins after a waiting period following enrollment (the specific period will be disclosed in your contract)
Pre-existing conditions, improper installation, code violations, and certain circumstances are typically excluded; refer to your service contract for the full list of exclusions
A service call fee applies each time a technician is dispatched; the amount will be disclosed in your contract
Rapid Home Warranty reserves the right to repair or replace a covered item at our sole discretion
Coverage limits and per-item caps apply and are specified in your service contract

Home warranty service contracts may be regulated by your state's department of insurance or department of consumer affairs. We operate in compliance with applicable state laws where required.

6. Pricing & Promotional Offers

Plan pricing displayed on this Site is subject to change without notice. Final pricing will be confirmed by a Rapid Home Warranty representative prior to enrollment and specified in your service contract. Promotional pricing, discounts, and limited-time offers are subject to availability, applicable terms, and may be modified or discontinued at any time. No promotional offer communicated through this Site constitutes a binding commitment until confirmed in writing.

7. Cancellation & Refunds

Cancellation rights and refund eligibility for enrolled home warranty plans are governed by your service contract agreement and applicable state law. Generally:

You may cancel your plan within the time period specified in your contract for a full or pro-rated refund, subject to any service fees already incurred
After the initial cancellation window, cancellations are subject to the terms of your service contract

Quote requests submitted through this Site do not create any billing obligation, and no charges are assessed for requesting a quote.

8. Acceptable Use of the Site

You agree that you will not use the Site to:

Submit false, misleading, or fraudulent information in any form
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Transmit spam, junk mail, chain letters, or any unauthorized commercial communications
Attempt to gain unauthorized access to any portion of the Site, its servers, or any related systems or networks
Scrape, crawl, or otherwise harvest data from the Site using automated tools without our prior written consent
Introduce viruses, trojans, worms, or any other malicious or technologically harmful material
Violate any applicable local, state, national, or international law or regulation
Interfere with or disrupt the integrity or performance of the Site or any related systems

We reserve the right to terminate your access to the Site for any violation of these Terms.

9. Intellectual Property

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any materials from the Site without our prior written consent, except for temporary caching by your web browser for personal viewing.

The Rapid Home Warranty name, logo, and all related marks are trademarks of Rapid Home Warranty. Nothing in these Terms grants you any right to use our trademarks, service marks, or trade names.

10. User-Submitted Content

If you submit testimonials, reviews, feedback, or other content to us (“User Content”), you grant Rapid Home Warranty a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media. You represent and warrant that you own or control all rights in the User Content you submit, that it is accurate, and that it does not violate these Terms or any applicable law.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAPID HOME WARRANTY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE.

This disclaimer does not affect any warranties that cannot be excluded or limited under applicable law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAPID HOME WARRANTY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE THREE MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

13. Indemnification

You agree to indemnify, defend, and hold harmless Rapid Home Warranty and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or inability to use the Site; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party right, including intellectual property or privacy rights.

14. Third-Party Links & Services

The Site may contain links to third-party websites or services that are not owned or controlled by Rapid Home Warranty. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We strongly advise you to review the terms and privacy policy of every third-party site you visit. We shall not be responsible or liable for any damage or loss caused by or in connection with the use of or reliance on any third-party content, goods, or services.

15. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights.

Informal Resolution: Before initiating any formal legal action, you agree to first contact us at Contact@rapidhw.com and give us at least 30 days to attempt to resolve the dispute informally.

Binding Arbitration: If we cannot resolve a dispute informally, you and Rapid Home Warranty agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site (except for small claims court matters and claims for injunctive or other equitable relief) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in English and, unless required otherwise by applicable AAA rules, shall take place remotely.

Class Action Waiver: YOU AND RAPID HOME WARRANTY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

Exceptions: Notwithstanding the foregoing, either party may bring an individual action in small claims court, and either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

This arbitration agreement is subject to the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.).

16. Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the United States and the laws of the state in which Rapid Home Warranty maintains its principal place of business, without regard to its conflict of law provisions. For any matters not subject to arbitration under Section 15, you consent to the exclusive jurisdiction of the state and federal courts located in the Company's principal place of business.

Notwithstanding the foregoing, you acknowledge that home warranty service contracts may be subject to regulation under the laws of the state in which your covered property is located, and your rights regarding those contracts may be governed by such state laws.

17. Changes to These Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make changes, we will update the “Last Updated” date at the top of this page. For material changes, we will provide additional notice (such as an email notification or a prominent banner on the Site). Your continued use of the Site after any changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the Site.

18. Severability & Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of the remaining provisions. The failure of Rapid Home Warranty to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision unless acknowledged and agreed to by us in writing.

19. Entire Agreement

These Terms, together with our Privacy Policy and any service contract agreement executed at enrollment, constitute the entire agreement between you and Rapid Home Warranty with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, and agreements, whether oral or written, relating to such subject matter. In the event of a conflict between these Terms and an executed service contract agreement, the service contract shall govern with respect to the home warranty coverage.
